Score a win for Consumers in California

California voters and consumers just scored a major win despite substantial efforts from corporations and big business to change the laws regarding bringing lawsuits against corporations for false advertising.  These companies, tobacco, insurance and other large corporations spent five times the normal amount to get Proposition 64 passed so that they could claim exemptions from their false advertising.  It’s a wonder that Proposition 64 even passed in the first place, but score a major win for the consumers in this one and hopefully they as well as other consumers in other states will learn from this fiasco and understand the singular motive behind the corporations, money.  The San Francisco Chronicle has a great write-up on this entire story. “Consumers win with court’s Prop. 64 decision“. Clearwire Subscribers file Lawsuit

A lawsuit was filed today against Clearwire US, LLC (”Clearwire”) seeking certification of a class action on behalf of Clearwire subscribers. As alleged in the lawsuit, Clearwire entices consumers into long-term contracts for internet and phone service by advertising its service as a fast, reliable “always-on” alternative to cable or DSL internet access, and as a superior alternative to traditional land-line telephone service. But, according to the complaint, when those consumers seek to cancel their Clearwire service because they discover that, in fact, Clearwire service is slow and unreliable (or for any other reason), the consumers learn that their long-term contracts contain an Early Termination Fee provision pursuant to which Clearwire charges a fee of up to $220 for canceling. Verizon Wireless files lawsuit against telemarketers

Verizon Wireless said today it has filed a lawsuit to stop several telemarketers from calling its customers and employees with an offer of an extended car warranty. The lawsuit, filed in New Jersey Superior Court, names Dealers Warranty (doing business as Federal Auto Protection), National Dealers Warranty and Tele Europe, B.V., and alleges these companies are responsible for illegally using an autodialer to reach Verizon Wireless customers. Lawsuit filed against Sun Trust Banks

Atlanta-based law firm Webb, Klase & Lemond, LLC has filed a class action lawsuit against SunTrust Banks, Inc. alleging that SunTrust engages in fraudulent, deceptive, unfair, and bad faith business practices with respect to its assessment of overdraft fees on consumer checking accounts. The suit also claims that SunTrust, which is headquartered in Atlanta, Georgia, has engaged in improper and unfair practices in order to increase the number and amount of overdraft and/or service fees imposed upon consumers’ accounts. The case, styled Peterson v. SunTrust Banks, Inc., was filed in the Superior Court of Fulton County, Georgia on April 8, 2009 and has been assigned Case No. 2009CV167326. Read more
