Personal Injury

Personal injury is the practice of law which protects those suffering injury as a result of an accident or medical malpractice. Personal injury can be either physical or psychological. Personal injury law is also referred to as tort law. The most common types of personal injury claims include car accidents, work accidents, assault and defective products. Personal injury victims can file claims for damages which include physical injury, psychological injury and also potentially for property injury. Medical malpractice and dental malpractice are additional types of common claims and industrial toxic injury claims such as Asbestos and Mesothelioma. Defective products are also very common and include lead poisoning, pharmaceutical drugs, medical products, and other toxic chemicals and dangerous medical devices.

Personal Injury Claims

Personal injury claims provide for the financial compensation of an injury to cover psychological injury, physical injury, loss of income, pain and suffering, permanent disability, related medical expenses and other related injuries. If you or a family memeber you are acting on the behalf of has been injured, you should seek qualified legal representation from an experienced personal injury lawyer. An experienced personal injury lawyer will know how to build your case and take your case to trial if necessary. Personal injury lawyers will take your case on contingency, which means you won't have to pay any fees for their services unless they win your case for you.

Personal Injury Torts

Torts are civil wrongs recognized by law as grounds for a lawsuit. These wrongs result in an injury or harm constituting the basis for a claim by the injured party. While some torts are also crimes punishable with imprisonment, the primary aim of tort law is to provide relief for the damages incurred and deter others from committing the same harms. There are numerous specific torts including trespass, assault, battery, negligence, products liability, and intentional infliction of emotional distress.

Torts fall into three general categories: intentional torts, negligent torts and strict liability torts. Intentional torts are those wrongs which the defendant knew or should have known would occur through their actions or inactions. Negligent torts occur when the defendant's actions were unreasonably unsafe. Strict liability wrongs do not depend on the degree of carefulness by the defendant, but are established when a particular action causes damage. Tort law is state law created through judges (common law) and by legislatures (statutory law).
