MOTHER FOUND NOT GUILTY IN BABY’S DEATH FROM INJURIES

In what he called “a truly tragic case,” Judge Charles Wittenberg ruled yesterday in Lucas County Common Pleas Court that Stacy Hall is not guilty in the death of her 9-month-old daughter.

Judge Wittenberg said prosecutors had not proven that Ms. Hall abused her child or recklessly violated her legal duty to care for her.

Tyler Hall died July 1, 1996, at St. Vincent Mercy Medical Center of severe brain damage sustained in the family’s Putnam Street home three days earlier.

On reason Judge Wittenberg reached a verdict of not guilty was, he said, “Experts differed in their conclusions as to the mechanism” that caused the injury.

A number of local nurses and doctors testified during the eight-day trial that the damage done to Tyler was too severe to have come from a fall from a bed onto a carpeted floor, as Ms. Hall contended.

Expert witnesses for the defense, however, said the brain damage sustained by the child was consistent with that type of fall if a child landed on the head.

The judge said he took into account there was no evidence of any earlier abuse or neglect by the defendant of either of her daughters.

Ms Hall, in a dark orange suit, remained stoic as she had through most of the trial as the judge explained his reasoning. When he announced his verdict she jumped to her feet, but her elation was interrupted when her father James, slumped to the floor of the courtroom. He was treated at Flower Hospital.

Ms. Hall said she knew she was innocent, but was excited to hear the judge announce his finding.

Another daughter, Taylor, 3 is with her paternal grandmother under the jurisdiction of the Children Service Board.

Lorin Zaner, Ms Hall’s attorney, said he will ask juvenile court that his client first receive extended unsupervised visitation with the girl, and then have custody revert to Ms. Hall
