TRIAL JUDGE TO RULE ON USING BLOOD TEST RESULTS

Judge Frederick McDonald of Lucas County Common Pleas Court said he will rule tomorrow on whether prosecutors can use the results of a blood-alcohol test performed at St. Luke's Hospital after an auto accident that killed four people. He said he would have his ruling prior to the scheduled beginning of the trial of Theodore Williams, 56, of Ypsilanti, Mich., who is charged with four counts of vehicular homicide and four counts of involuntary manslaughter resulting from the crash.

Prosecutors charge that on Nov. 1, 1997, his car crossed the center line in the 7800 block of Airport Highway in Springfield Township and crashed head-on into the westbound auto of Tyrone Scott, 27, of Secor Road. Prosecutors contend that Mr. Williams was under the influence of alcohol when the crash occurred. Lorin Zaner, attorney for Mr. Williams, contends that the blood alcohol content should not be admitted because the hospital used procedures that differ from those used by police agencies in drunken driving cases.

Mr. Scott and his nephew, Andrew Scott, 5, were pronounced dead at the scene. Tyrone Scott's mother, Susan Scott, 52, of Dix Lane, died a short time later in St. Luke's Hospital and his daughter, Rachel, 7, died not long after being admitted to Medical College of Ohio Hospital.

Mr. Williams also is charged with aggravated vehicular assault stemming from injuries suffered by Mr. Scott's son, Julian, 9. Conviction on that charge carries a term of 6 to 18 months in jail. It is possible to be convicted on all of the other eight counts, but only sentenced on four of them. Each charge carries a sentence of one to five years in prison.
