AUTO ACCIDENTS

There are different insurance coverages that pay benefits if you are injured in an automobile accident in Florida.

1. Personal Injury Protection (PIP) Benefits:

Florida is a "no-fault" state. If you have this coverage, under Florida's "no fault" system, you are entitled to 80% of your medical expenses and 60% of your lost wages. PIP coverage is usually $10,000. It can be sold with a “deductible” that can decrease your coverage. If you are in another person’s car and have no insurance, you may recover PIP benefits from the insurance company for the car you are in.

2. Liability Coverage:

This is insurance on the car (or driver of the car) that caused the accident. This coverage pays for your medical bills and lost wages over and above your PIP coverage. This is also the coverage that pays for your mental anguish, pain, suffering, scarring, the loss of enjoyment of life and any related damages.

3. Uninsured Motorist Coverage:

This is coverage you purchase. If you have UM coverage and the value of your case exceeds the coverage available from the person that hurt you, you can make a claim against your own insurance company.

What should you do after an auto accident?

1. Florida law requires that you exchange certain information and/or provide certain information to the police investigating the accident. When exchanging information with the other driver, do not discuss the facts or your opinions about what happened.
2. Get the names and addresses of any witnesses to the accident.
3. You should see a doctor to be checked for injuries.
4. Report the accident to your insurance company.
5. Take photos of your car.
